TERMS OF SERVICE: HEAD 2 TOE STRENGTH

By accessing the services, website, or digital programs provided by Head 2 Toe Strength, you (the "Client") agree to be legally bound by these Terms of Service. If you do not agree, you must cease use of our services immediately.

01. THE CLINICAL RELATIONSHIP & SCOPE

Head 2 Toe Strength is an Integrated Clinical Practice.

  • Clinical Exercise Physiology: Services provided by Bethany Busch, MS, CSCS, ACSM-EP consist of biomechanical loading, structural architecture, and nervous system regulation. This is not "personal training," but clinical-grade exercise physiology.

  • Licensed Psychotherapy: Services provided by Auria Zahed, MS, LMFT are governed by the California Board of Behavioral Sciences.

  • Non-Medical Care: Our services are consultative and supportive. We do not provide primary medical care, diagnosis of disease, or emergency psychiatric services. You must maintain a relationship with a primary care physician.

02. PRIVATE PAY & INSURANCE DISCLAIMER

Head 2 Toe Strength is a 100% Private Pay practice. * No Insurance: We do not interface with insurance companies or third-party payers.

  • No Documentation: We do not provide medical coding, Superbills, or documentation for HSA/FSA reimbursement.

  • Financial Responsibility: By booking, you assume 100% financial responsibility. You agree not to attempt to submit our receipts to insurance providers for reimbursement.

03. PAYMENT, CANCELLATION, & LATE POLICY

  • Advance Payment: Full payment is required at the time of booking to secure a dedicated clinical time slot.

  • Strict 24-Hour Cancellation: Cancellations or rescheduling requests made less than 24 hours before the appointment result in the forfeiture of the full session fee. This reflects the reservation of clinical time that cannot be filled on short notice.

  • Late Arrivals: Sessions begin and end at the scheduled time. Late arrival does not extend the session duration, and the full fee remains due.

04. REFUND & CHARGEBACK POLICY

  • Final Sale: All services, including the Deep Dive Reclamation Audit and monthly programs like The Bethany Method™, are non-refundable.

  • Program Commencement: Once a clinical program has begun, no refunds will be issued for unused portions of the month.

  • Chargeback Waiver: By purchasing, you explicitly waive the right to dispute charges (chargebacks) with your credit card provider for services rendered or fees incurred under these cancellation terms.

05. INFORMED CONSENT & ASSUMPTION OF RISK

You acknowledge that integrated clinical care involves physical exertion and psychological exploration. You voluntarily assume all risks, including the risk of injury or exacerbation of existing conditions (e.g., PCOS or autoimmune flares). It is your responsibility to disclose all medical conditions and medications to your providers.

06. LIMITATION OF LIABILITY

To the maximum extent permitted by California law, Head 2 Toe Strength and its providers shall not be liable for any direct, indirect, or consequential damages resulting from your use of our services. Our total liability shall not exceed the amount paid by the Client for the specific service in question.

07. INTELLECTUAL PROPERTY

All program materials, including The Embodied Edge™, Move to Mend™, and custom clinical protocols, are the intellectual property of Head 2 Toe Strength. You are granted a personal, non-transferable license for use but may not distribute, sell, or "white-label" our clinical methods.

08. GOVERNING LAW & JURISDICTION

These terms are governed by the laws of the State of California. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts located in Orange County, California.
